Record Of Toby Giles Injuries                    

Below is a chronological record of injuries sustained by Toby (Paul) Giles whilst in the care of Rookwood Hospital, which is run by the local authority. Although this report commences 13th January 2006 there have, in the past, been numerous other unrecorded incidents as Toby has been in Rookwood for over 4 years. Not all photo's are included yet and   also some dates need to be added


13/1/06 - Friday
Toby has two fairly large lacerations, each approximately size of a 20p, on his left shin. Thought to be caused by the release tap on leg bag pressing against the leg, for a long period, judging from the extent of the injury. He did not have an injury at last visit (10/1/06).
Toby has a laceration to the left side of his neck, which is very sore, caused by the of the Velcro strip that holds the tracostamy collar on. The strip is the same   width as the collar so the edge sits directly onto the skin and is rubbing. Also area around traccy is sore and dirty.

17/1/06 - Tuesday
Toby’s neck is still sore, due   to no padding!. We put some padding under the Velcro strip and once again asked nurses to carry on doing this. Area under traccy is still very sore.
The lacerations to Toby’s left shin appear to be slowly better.

19/1/06 - Thursday
Toby’s neck is still sore and once again not padded!! His leg is still marked but getting better.

23/1/06 - Monday
Toby’s leg and neck injuries are now getting better, the area around the traccy is still red. Also noticed some odd looking marks on his back, he did not have them before entering Rookwood hospital.

25/1/06 - Wednesday
Missed. Informed by Gail that Toby’s   neck and leg are still marked.


27/1/06 - Friday
Toby’s injuries are now all but gone.

6/2/06 - Monday
Today I realised that it is the hospital razors that are making Toby’s face to become red and sore. Couldn’t shave him today as his face is to sore to touch. There is still a slight mark on Toby’s leg

Toby’s leg still has a faint mark on his leg, plus his face and neck are almost. better.

Toby’s neck, leg and face injuries have finally cleared up.


20/2/06 - Monday
The left side of Toby’s neck is sore again due to the Velcro strip having no padding under it.
Toby’s eyes are also sore.

Toby’s neck is unpadded again!!, Gail and I padded it and again asked the nurses to keep doing so.

8/3/06 - Wednesday
The area under Toby’s traccy is really sore and the inside of his traccy is dirty and smelly. We told the nurses.


10/3/06 - Friday
The area under Toby’s traccy is still very sore and marked.


24/3/06 - Friday
Toby’s eyes are so sore he is unable to open them, lee (nurse) said they had been like that yesterday and he said he would bathe them. Today Toby had his Traccy changed.

21/4/06 - Friday
Erica (nurse) changed Toby’s traccy and informed me that it would be changed every month.


5/5/06 - Friday
Toby is fine today, although Gail and I noticed that his right hand was unusually warm.


7/5/06 - Sunday
When nurses were giving Toby his morning shower they noticed a swelling to his right hand. Erica, (one of the nurses who discovered the swelling), informed Alan by phone of the injury. I was then informed, via Candy of the incident on the phone.
The hospital is unsure if his hand is broken and they do not know how this injury occurred? They say they are unable to x-ray it because the swelling is so bad. Nurses are hoping to x-ray Toby’s hand tomorrow.
I last saw Toby on 5/5/06, at this time his hand was fine.


8/5/06 - Monday
Hospital took x-rays today and the results will be back tomorrow.


9/5/06 - Tuesday
I was so shocked at Toby’s injury that I bought a disposable camera and took photos of his hand at 3.30pm. Also present was a hospital photographer he to was taking photos. Apparently Alan had ordered an inquiry into how Toby received the injury. I have never seen these photos.
I then went to see Mike Tonkin, hospital social worker, to talk to him about it, he said he had not been informed about the incident. Once again there is a mark on Toby’s ankle
The results of the x-rays was inconclusive due to the swelling being so severe.

12/5/06 - Thursday
Toby’s bandage was taken off his hand, it is still very bruised. He also has a laceration which is at the base of the index finger of his bad hand, iodine has been applied. Also Toby still has a mark on his ankle. Still no-body seems to know how this happened. Toby is still on paracetamol   for the pain in his hand.

15/5/06 - Monday
Toby’s hand still bad and also his face is very sore and red. There are splints that are used to keep Toby’s from curling around but they are not being used. Still has mark on ankle.

17/5/06 - Wednesday
Today the hospital informed me that Toby’s hand is fractured, they gave no explanation?
I was told in two separate meetings that the results of the inquiry, ordered by Alan, were inconclusive?!! Toby’s face is a little better and the mark on his ankle is still the same. Also he had to wear a splint for 24 hours.

Toby’s face is much better today.

23/5/06 - Tuesday
Toby’s and is still bruised and he has to have it strapped 24 hours a day.

Toby’s hand is still bruised and strapped up. His ankle is a bit better but his lips very dry and cracked. We put some hospital balm (yellow paraffin) on them.

Toby’s hand looks better today.

2/6/06 - Friday
Toby’s hand is still strapped and bruised but his ankle is almost cleared up. Also lee (nurse) informed me that Toby finished his course of paracetamol on 31/5/06

16/6/06 - Friday
Toby’s ankle a bit better and his eyes are very sore. Also Toby has bad cradle cap behind his ears.

20/6/06 - Tuesday
Toby’s has had the splints and bandages removed on Sunday 18/6/06, it is still very bruised.

Toby’s hand still a little bruised and still has a mark on his ankle.

Toby’s hand is better just a faint bruise left. Also took photos of Toby’s eyes and face which are both really red and sore.

Toby’s and is a little better and he still has a mark on ankle.

Toby has pneumonia and his hand is only slightly bruised.

Toby’s hand is still a little bruised and he now has a sore on his left shin again!!?

Toby’s eyes are so sore he is unable to open them. Toby’s hand almost better and the marks on his leg and ankle are getting better

Toby’s eyes are still bad and he has been prescribed a course of eye drops.   Also his hand is better but the marks on his neck and ankle are still slightly   showing. No photos.

28/7/06 - Friday
Toby’s leg and ankle are almost better.

3/8/06 - Thursday
Toby’s leg and ankle injuries have finally cleared up, he also has very small red spots on his arms?

9/8/06 - Wednesday
We noticed Toby’s nostrils are flaring up, this could be a sign of an infection. I noted that Toby is still on anti-biotics for the injury to his hand.

15/8/06 - Tuesday
Toby is very ill today, apparently he has a twisted gut and still has pneumonia? He has an intravenous drip in his bad hand, a drip in his right forearm and a fluid drain coming out of his stomach. He has also been put on oxygen.

17/8/06 - Thursday
Took photos of almost healed hand and shin, his eyes are still very sore.
Gail and I then witnessed one of the ‘bank’ nurses make, what in our opinion, a serious cross contamination error. After cleaning Toby’s traccy the nurse should have changed the suction pipe to then clean his mouth. By the time Gail pointed this out it had already entered his mouth. The then changed the pipe but made no attempt to clean the potentially cross-contaminated area, e.g. the mouth.

21/8/06 - Monday
Toby’s leg slightly bruised even though it is better.

23/8/06 - Wednesday
The Velcro strip not padded again, causing another sore to the left side of his neck and his leg is still bruised, took photos.
At approx’ 9.30pm Candy phoned to tell me that the hospital had administered Toby an overdose??? They said that it was immediately flushed out. I received on explanation about this, it worries me because in my opinion is a very serious mistake on the part of the hospital. I do not recall an investigation into this matter.

4/9/06 - Monday
Gail and I were shown the x-rays of Toby’s lung and discussed the deteriation of Toby’s lung due to continual infections. Toby has pneumonia and is still on antibiotics   for the injury to his hand which occurred on 5/5/06.

6/9/06 - Wednesday
Toby’s eyes are still sore and it is the last day of antibiotics. We were also informed that he has Gingivitis. Leg and ankle are still bruised.

18/9/06 - Monday
Once again Toby’s eyes are so sore he is unable to open them!!! His leg   and ankle are still bruised and his feet are starting to turn in really badly. Also he is still on oxygen.

20/9/06 - Wednesday
Toby’s leg and ankle still bruised, also his face is very sore again and his eyes are bad.

Once again there is no padding under the Velcro strap and his neck is red but not sore, we padded it. His leg and ankle are still bruised.

28/9/06 - Thursday
Toby’s leg and ankle are still bruised and he is not on the oxygen. His face is very sore but at least there was padding under the Velcro strap.

4/10/06 - Wednesday
Toby’s leg is looking better today, his ankle is a little bruised and both of his feet are turning in. Went to physiology department about it (see hospital negligence)

Although Toby’s hand is better there still seems to be a faint bruise on his index finger. Also his right ankle and leg are bruised.

12/10/06 - Thursday
Toby’s left ankle is now also bruised, his right leg is still a little bruised and his feet are still turning in slightly.

14/10/06 - Saturday
Toby’s right ankle is still bruised and there is a new injury on his right leg. I can still see a faint bruise on the middle finger of his healed hand.

16/10/06 - Monday
Toby’s face is very sore and the new injury from 14/10/06 is still very bad. Also his ankle is still bruised and under his Tracy is very sore and the Tracy is very dirty. Plus there is still a very faint bruise on the middle finger of healed hand.

18/10/06 - Wednesday
Toby’s right leg is still marked and he now has a mark on his left leg due to urine bag pressing against his leg. His face is a little better but the mark on his ankle is really bad and the faint bruising on index finger of healed hand is still faintly   bruised. Once again there was no padding under Velcro strip so I padded it.

20/10/06 - Friday
Toby’s leg is still bruised and he still has a mark on his ankle. Also the index finger of healed hand still has a very faint bruise.

24/10/06 - Tuesday
Toby’s leg and ankle are still marked but fading, also his index finger of healed hand still has a faint bruise. Toby is suffering from another lung infection and is finding it very hard to breathe.

Hospital Negligence


This report should be read in conjunction with the record of the injuries that Toby sustained whilst in the care of Rookwood hospital. Toby’s injuries are explained in greater detail   along with records of the photos taken.

13/1/06 - Friday
Toby’s toothbrush is in his draw with everything else, very unhygienic! Toby’s leg is marked and nurses have no explanation? Due to lack of constant care and attention Toby’s traccy is dirty and it is very sore and inflamed underneath. His neck is sore from the Velcro strip and I had to pad it!

17/106 - Tuesday
Today the wards in the hospital were locked as they are short staffed!! Toby still has the same padding that I put on him last Friday!

19/1/06 - Thursday
Toby’s neck is unpadded again so I again padded it and asked nurses to keep it padded. When I arrived Toby was in his wheelchair the stabilisers were not down, this means Toby could fall backwards so I put them on. Plus his wheelchair is still stinking

23/1/06 - Monday
Once again Toby’s neck is unpadded so again I padded it!! Toby’s wheelchair is still stinking and there are no cushions for his elbows, to prevent them from getting sore or marked.

27/1/06 - Friday
Toby’s leg is still marked from 13/1/06 and his wheelchair is still stinking.

31/1/06 - Tuesday
Wheelchair is still the same and he is dressed like a tramp so we redressed him.

6/2/06 - Monday
Toby’s face is very sore and he is unable to be shaved, no-one knows why? His toothbrush is still thrown in the draw which is always messy. Toby’s wheelchair is still stinking and his leg is still marked but it is fading.

8/2/06 - Wednesday
Toby’s neck is better due to I and Gail padding it. Also I soaked his toothbrush in boiling water to kill any germs and his wheelchair is still stinking.

20/2/06 - Monday

24/2/06 - Friday
Toby’s eyes are sore due to continual exposure to daylight and hospital lighting. Wheelchair as above.

8/3/06 - Tuesday
Today there was a notice on the wall by Toby’s bed saying that he must wear splints on both hands at night, but there was only one splint? I then went to the physiotherapy department to speak to Nicky about another splint and she ordered a new pair. These took three weeks to arrive. Once again due to lack of constant cleaning, the area under Toby’s ’traccy’ is sore. Wheelchair and toothbrush as above.

10/3/06 - Friday
When I arrived Toby was sat in his wheelchair, I noticed that the brakes were not on!!!, so I put them on myself. Also both his stabilizers were up when they should be down. Draw and wheelchair still the same.

22/3/06 - Wednesday
Toby’s ’traccy’ is once again dirty so I informed the nurse.

24/3/06 - Thursday
Today two nurses (Erica and Lee) changed Toby’s ’traccy’. Toby’s eyes are so sore that he is unable to open them. This is due to the lack of adequate shading from daylight and artificial hospital lighting. His wheelchair is still stinking.

30/3/06 - Thursday
Toby’s new splints have finally arrived!! His wheelchair is still the same.

I asked to see Dr Hughes but he was not available, I was told he would get back to me??

7/4/06   - Friday
I waited for Dr Hughes to get in touch but he didn’t!! Toby’s wheelchair is still the same.

11/4/06 - Friday
Today I found out that Dr Hughes is no longer Toby’s consultant and that his new consultant is Dr Jennie Thomas. I have received not correspondence informing me of this change. Yet again Toby’s wheelchair is still stinking. It is so short-staffed that several of Toby’s belongings have gone missing, including a scarf, a leopard blanket, a personal stereo, balls that Toby used to exercise his hands and much more.

19/4/06 - Wednesday
I saw that Toby had dirty, urine smelling clothes in the same cupboard as his clean clothes and his wash bowl is full of dirty washing. I went to do Toby’s washing in the hospital laundry only to find that ‘keg’ mop heads were being washed in the same machine as patients clothing!! Gail took the washing home, this is actually Beverley’s allotted responsibility.
I then went to see Mike Tonkin (hospital social worker) about Toby’s belongings going missing. He said that he would arrange a meeting with him, myself, the P.O.V.A team and the ward manager (Angela) to discuss the issue. The meeting never happened??

21/4/06 - Friday
Today Erica changed Toby’s ‘traccy’ and informed me that this will be done every month. We returned Toby’s clean washing.

25/4/06 - Tuesday
Once again Toby’s clothes were dirty and smelly and once again we found the patients washing machine being used to wash ‘keg’ mop heads. Gail took it home again. Wheelchair still the same.

5/5/06 - Friday
We took Toby down to the ‘den’ in his wheelchair, we returned him to the ward at about 2.30pm and then went home.

7/5/06 - Sunday
I was today informed by Candy, via the telephone that Toby had sustained a serious injury to his right hand. Apparently Alan was informed by the hospital staff that morning. The staff were unable to determine if it was broken or not because of the severe swelling!!!

9/5/06 - Tuesday
I was so shocked by Toby’s injury that I bought a disposable camera and took photos of the injury. I then went to see the hospital social worker about it and discovered that he knew nothing of the injury prior to me telling him. I also went to see Angela (assistant ward manager) but she was unavailable. Then I spoke to Margo (ward manager) and she informed me that an investigation into the cause of Toby’s injury will take place.

15/5/06 - Monday
The splints for Toby’s hand are still in the bag and haven’t been used.. Toby’s teeth have not been cleaned for three weeks, this is because the hygienist   says he needs a special brush. He is still waiting for it to arrive. Toby’s face sore and Gail had to inform the nurses which cream to use (Dactacor).

16/5/06 - Tuesday                                                        
Today I phoned P.O.V.A who have still not replied since I went there on 10/5/06. I briefly spoke to Simon Williams he told me he would talk to his colleagues about all the issues and get back to me. He never did!!!

17/5/06 - Wednesday
Gail and I discussed Toby’s injury with both Jennie Thomas and Margo in the office and they now know that the injury is a fracture!! They are investigating who handled him between Friday night (5/5/06) to Sunday morning (7/5/06). Also Toby’s face is much better, due to the advice of Gail!!

19/5/06 - Friday
Once again Toby’s dirty clothes are in with his clean clothes. Toby’s face is better!! Candy took Toby’s washing home. His wheelchair is still dirty!!

23/5/06 - Thursday
Toby’s nebuliser is only to be put on for 10 minutes at a time, but today it was left on for 35 minutes! It was put on at 12.10pm and Gail turned it off at 12.45pm. Spoke to Jennie Thomas????

25/5/06 - Thursday
Toby still has no toothbrush which means his teeth have not been cleaned for 4 weeks!

2/6/06 - Friday
Today the hospital ran out of ‘phenibarbatone which is used to control Toby’s fits. They had to send for some from the Heath, Lee was worried that it wouldn’t arrive in time. But credit where credit is due it arrived on time.

6/6/06 - Tuesday
Gail and I had a conversation with Jennie Thomas and we talked about the possible movement of Toby to a specialist home in Gwent. She informed us that this particular home could cater for all of Toby’s needs. I suggested the place in Swansea that had been put forward 3 years earlier by Andrew Harding (receiver), Dr Thomas said she would get in touch with this place. We heard nothing until (6/7/06). This conversation was conducted by Toby’s bed-side between 11 -11.30am.

16/6/06 - Friday
Toby’s eyes are sore again and he has a very bad build up of cradle cap behind his ears. This build up could be due to lack of through washing? Once again urine smelling clothes are mixed with clean clothes at the bottom of Toby’s cupboard.

20/6/06 - Tuesday
When I arrived on the ward I discovered that the urine smelling clothes, form 16/6/06(Friday), were still in the cupboard with more besides. I asked Jennie Thomas for the address of the home in Swansea, as nobody had gotten back to me. Dr Thomas assumed that the ward sister (Sarah) had informed me of it!!??

6/7/06 - Thursday
Today at 2.00pm we had a meeting with Jennie Thomas to discuss Toby’s pneumonia. Whilst I was there I asked her for so information about the home in Swansea. She kindly downloaded the necessary information from the internet. The print out she gave me was about a place called ‘Awel-y-mor’ which specialises in brain-injured patients.

10/7/06 - Monday
Again the tap on Toby’s urine bag is up instead of down, this prevents it from draining properly so we put it down.

12/7/06 - Wednesday
Lee changed the dressing on Toby’s leg, but they still have no explanation as to how it happened??? Toby’s wash bag is again full up and overflowing with dirty smelly clothes.

18/7/06 - Tuesday
Toby’s wash bag is still full and overflowing with urine smelling clothes and his elbow cushions were on the dirty floor. I saw Jennie Thomas and asked about the place in Swansea and she informed me that she was still waiting to hear from them. At 12pm the physiotherapist came to see Toby. On our return at 1.20pm we noticed that when the physiotherapist had gone leaving the guards to Toby’s bed up, this means that Toby could easily fall out of   bed at any time. We immediately put the guards down, on the left side.

20/7/06 - Thursday
Toby’s wash bag is still the same so once again Gail took it home to wash. I asked Margo (ward manager) the progress of the investigation into Toby’s hand injury. She informed me that the inquest was still on going.

24/7/06 - Monday
Toby’s wash bag is still the same so again Gail took it home and washed it and once again his eyes are sore (no shade).

26/7/06 - Wednesday
Toby has been put on a course of eye drops and again there are dirty clothes in with clean clothes.

3/8/06 - Thursday
Toby’s eyes are still sore due to excess light!! Also Toby’s tooth brush is in the same dish as his ‘traccy’ stoppers. I removed the tooth brush and sterilised in boiling water. Once again his wash bag is over flowing.

9/8/06 - Wednesday
Today Toby doesn’t have a tooth brush at all? Again his wash bag is full and on the floor and his wheelchair is still stinking. At the moment Toby is in a hospital bed as his is being fixed.

15/8/06 - Tuesday
The surgeon informed candy, Gail and my self that Toby may need to be moved to the Heath as he has a twisted gut.

17/8/06 - Thursday
Toby’s eyes are sore. Toby has ‘bank’ nurses at the moment and we witnessed one of them make a grave error.

21/8/06 - Monday
Toby has another leg injury due to the nurse trying to find a vein!

23/8/06 - Wednesday
Toby has another neck injury as nurses again left the Velcro strip unpadded. I padded it and asked the nurses to keep it this way. At 9.30pm Candy phoned me to say that Toby had been given another
Overdose!!!!

25/8/06 - 2/9/06
I went away to London between these 2 dates so nothing to report.

4/9/06 - Monday
Toby has had pneumonia from 6/7/06 , the doctor showed Gail and myself x-rays of Toby’s lungs. He explained that Toby has fluid on his right lung which has been there since 6/7/06 and that the lung is basically ceasing to work. Also Toby’s teeth are still not being cleaned and they only got cleaned today because the hygienist did them.

6/9/06 - Wednesday
We were told today that Toby has Gingivitis, possibly due to lack of dental hygiene. Toby’s splints have not been used since the start of his hand injury.

12/9/06 - Tuesday
Toby’s eyes are still sore!!

18/9/06 - Monday
Toby’s feet are turning in very badly which could be due to lack of physiotherapy. His eyes are so sore he is unable to open them so I bathed them for him. Once again Toby’s tooth brush is in with his ’traccy’ stoppers so once again I removed it and sterilised it in boiling water.

20/9/06 - Wednesday
Once again Gail had to tell the nurses what to use on his sore face??!!

26/9/06 - Tuesday
Once again there was no padding under the Velcro strip and Toby’s neck was a little red so I padded it for him. Whilst Toby was sat in his wheelchair I noticed that the stabilisers were up instead of down and the brakes were not on, we corrected this immediately. Toby’s tooth brush was again thrown in his draw.

28/9/06 - Thursday
Toby was in his wheelchair with the stabilisers up so we put them down for him.

4/10/06 - Wednesday
Toby’s feet are turning in really badly! His tooth brush is still thrown in the draw and his razor is thrown in the window. Also the suction pipe (tubing) was dragging on the dirty floor and his oxygen bottle is filthy.

10/10/06 - Tuesday
Toby’s towel and sling are both thrown under his bed on the dirty floor.

18/10/06 - Wednesday
Wheelchair and draw still the same and his face is still sore.

20/10/06 - Friday
Today we were told that there had been an outbreak of a virus on wards 4, 6, 7 & 8. Toby’s draw is still messed up, as usual. I was informed by someone that the outbreak started on Tuesday 10/10/06. I wonder why we had not been informed earlier?

24/10/06 - Tuesday
There is a pressure sore under Toby’s coxsix due to being sat in his chair in the same position for to long. Toby is often left in his chair for far longer than he should be, in my opinion. Also today Toby had x-rays done on his chest.

26/10/06 - Thursday
I asked Erica about the results of the x-rays on Toby’s chest, she informed me that she didn’t know that any x-rays had been done and she went to find out. When she returned she said she would need to speak to the consultant as she didn’t understand it???!! I didn’t get to speak to the consultant as he was unavailable!! Also There were packets of suction tubes all over the floor.
